Esta política cuenta cómo funciona el producto de verdad, con el detalle que exige el Reglamento (UE) 2016/679 (RGPD) y la LOPDGDD. Está escrita para entenderse, no para cubrir el expediente.This policy tells you how the product actually works, with the detail required by Regulation (EU) 2016/679 (GDPR) and the LOPDGDD. 1. Quién es quién1. Who's who

Ponktio es un servicio para empresas, y eso reparte los papeles en dos planos que conviene distinguir:Ponktio is a service for businesses, and that splits the roles into two levels worth distinguishing:

• De la cuenta de tu empresa (datos de quien administra, contacto y facturación), el responsable del tratamiento es TECNIART GALICIA, S.L. (CIF B27432525, Alameda Xavier Costa Clavell nº 3, 27500 Chantada, Lugo). • De los datos del personal que ficha, la responsable es la empresa que usa Ponktio: ella decide qué se registra y para qué. TECNIART GALICIA, S.L. actúa como encargada del tratamiento (art. 28 RGPD), siguiendo sus instrucciones. El contrato de encargo está disponible para cada empresa cliente.For the data of the staff who clock in, the data controller is the company using Ponktio: it decides what is recorded and why. TECNIART GALICIA, S.L. acts as data processor (art. 28 GDPR), following its instructions. The data processing agreement is available to each client company.

2. Qué datos se tratan2. What data is processed

De quien administra la empresaAbout the company administrator

• Correo electrónico y contraseña (esta, cifrada con Argon2id; nadie puede leerla).Email address and password (the latter, hashed with Argon2id; nobody can read it).
• Datos de facturación de la empresa. Si hay pagos, los procesa Stripe: aquí no se almacenan datos de tarjeta.The company's billing data. If there are payments, Stripe processes them: no card data is stored here.

De cada persona que fichaAbout each person who clocks in

• Nombre con el que aparece en el panel y, si tiene cuenta, su correo — guardado cifrado y con una huella que permite buscar sin descifrarlo.The name shown on the panel and, if they have an account, their email — stored encrypted and with a fingerprint that allows searching without decrypting it.
• Los fichajes: qué acción, cuándo la capturó el aparato, cuándo llegó al servidor y qué hora se considera válida.The punches: which action, when the device captured it, when it reached the server and which time is considered valid.
• Un seudónimo del dispositivo, elegido por la propia persona. Nunca el IMEI ni identificadores de publicidad.A pseudonym for the device, chosen by the person themselves. Never the IMEI or advertising identifiers.
• El desfase del reloj del aparato, para saber si una hora es de fiar.The device clock's offset, to know whether a time is trustworthy.
• Ubicación puntual al fichar, solo si la empresa lo activa. Está apagado por defecto. Activado, la app adjunta un único punto en el momento de fichar — nunca hay seguimiento continuo — y la persona lo sabe, porque su app se lo dice y el permiso lo concede ella. La decisión de activarlo, con su base legal, es de la empresa.A one-off location when clocking in, only if the company enables it. It's off by default. When enabled, the app attaches a single point at the moment of clocking in — there is never continuous tracking — and the person knows it, because their app tells them and they grant the permission. The decision to enable it, with its legal basis, is the company's.
• El PIN de kiosco, si la empresa usa ese modo, guardado con huella criptográfica.The kiosk PIN, if the company uses that mode, stored as a cryptographic fingerprint.

Lo que no se trataWhat is not processed

• Datos biométricos. Ni huella, ni cara.Biometric data. No fingerprint, no face.
• Contenido del trabajo: qué se hizo, con quién, en qué.The content of the work: what was done, with whom, on what.
• Publicidad, perfiles o analítica de terceros: nada. La web pública mide las visitas de forma agregada con una herramienta propia (Umami, en servidor propio), sin cookies y sin datos personales.Advertising, profiling or third-party analytics: none. The public website measures visits in aggregate with our own tool (Umami, self-hosted), without cookies and without personal data.

3. Para qué y con qué base3. Purpose and legal basis

• Prestar el servicio de registro de jornada — ejecución del contrato (art. 6.1.b RGPD) y, para el personal, cumplimiento de la obligación legal de registro de jornada (art. 6.1.c RGPD y art. 34.9 del Estatuto de los Trabajadores).Providing the service of time tracking — performance of the contract (art. 6.1.b GDPR) and, for staff, compliance with the legal obligation to record working time (art. 6.1.c GDPR and art. 34.9 of the Workers' Statute).
• Avisos transaccionales (verificación, invitaciones, restablecimiento de contraseña) — ejecución del contrato.Transactional notices (verification, invitations, password reset) — performance of the contract.
• Seguridad y auditoría del propio servicio — interés legítimo (art. 6.1.f RGPD).Security and auditing of the service itself — legitimate interest (art. 6.1.f GDPR).
• Ubicación al fichar — solo si la empresa la activa, con la base legal que a ella corresponde documentar.Location when clocking in — only if the company enables it, with the legal basis it is responsible for documenting.

No hay decisiones automatizadas con efectos jurídicos ni elaboración de perfiles.There are no automated decisions with legal effects, nor profiling.

4. Cuánto se conserva4. How long it's kept

• El registro de jornada, cuatro años, porque lo exige la normativa española: es la prueba de las horas trabajadas.The time tracking record, four years, because Spanish law requires it: it's the proof of hours worked.
• Los datos operativos —sesiones, dispositivos, invitaciones— duran mucho menos y se purgan solos.Operational data —sessions, devices, invitations— last much less and are purged automatically.
• Si se elimina una cuenta, sus datos identificativos desaparecen; los de facturación se conservan el plazo que exige la normativa fiscal.If an account is deleted, its identifying data disappears; billing data is kept for the period required by tax law.

5. Con quién se comparte5. Who it's shared with

Con nadie, salvo lo imprescindible para que el servicio funcione:With no one, except what's essential for the service to work:

• Infraestructura: servidores en la Unión Europea.Infrastructure: servers in the European Union.
• Correo: DonDominio (España), para los avisos del servicio.Email: DonDominio (Spain), for service notices.
• Pagos: Stripe Payments Europe Ltd. (Irlanda), que trata los datos de facturación de la empresa, nunca los del personal.Payments: Stripe Payments Europe Ltd. (Ireland), which processes the company's billing data, never the staff's.
• Autoridades públicas, cuando una obligación legal lo exija.Public authorities, when a legal obligation requires it.

Nuestro equipo de soporte solo entra en los datos de una empresa con una autorización temporal que caduca sola, y cada acceso queda anotado en la auditoría de esa empresa, no solo en la nuestra.Our support team only accesses a company's data with a temporary authorisation that expires on its own, and every access is logged in that company's audit trail, not just in ours.

6. Seguridad6. Security

Cifrado HTTPS/TLS en tránsito, contraseñas con Argon2id, segundo factor disponible, aislamiento por empresa reforzado en la propia base de datos, límites de peticiones, copias de seguridad y bitácora de auditoría encadenada. En el móvil, la cola de fichajes sin cobertura se guarda cifrada y la clave vive en el almacén seguro del sistema.HTTPS/TLS encryption in transit, passwords with Argon2id, second factor available, per-company isolation enforced in the database itself, rate limits, backups and a chained audit log. On mobile, the offline punch queue is stored encrypted and the key lives in the system's secure store.

7. Tus derechos7. Your rights

Acceso, rectificación, supresión, oposición, limitación y portabilidad. Si eres parte del personal de una empresa cliente, el cauce natural es tu empresa (la responsable); también puedes escribir a info@tecniartgalicia.com y trasladaremos o atenderemos la solicitud según el papel que nos toque. Plazo máximo: un mes. Si crees que no se ha atendido bien, puedes reclamar ante la Agencia Española de Protección de Datos (www.aepd.es).Access, rectification, erasure, objection, restriction and portability. If you are part of the staff of a client company, the natural route is your company (the data controller); you can also write to info@tecniartgalicia.com and we will forward or handle the request according to the role we play. Maximum term: one month. If you believe it was not handled properly, you can lodge a complaint with the Spanish Data Protection Agency (www.aepd.es).

Un matiz honesto sobre la supresión: al ejercerla desaparece quién eras —nombre, correo, cuenta, dispositivos, PIN—, pero que alguien trabajó esas horas permanece sin identificarte, porque borrar el registro de jornada perjudicaría justo a quien lo pide: si mañana reclamaras horas impagadas, la prueba ya no existiría.An honest nuance about erasure: exercising it makes who you were disappear —name, email, account, devices, PIN—, but that someone worked those hours remains without identifying you, because deleting the time tracking record would harm precisely the person who asks for it: if tomorrow you claimed unpaid hours, the proof would no longer exist.

8. Menores8. Minors

El servicio se dirige a empresas y a su personal. No está pensado para menores de 16 años y no se crean cuentas para ellos.The service is aimed at companies and their staff. It's not intended for minors under 16 and no accounts are created for them.

9. Cambios en esta política9. Changes to this policy

Si cambia algo sustancial, se avisará a las empresas clientes con antelación razonable y esta página reflejará siempre la versión vigente.If anything substantial changes, client companies will be notified with reasonable notice and this page will always reflect the current version.
